Intellectual Property

All content published on this website — including but not limited to texts, photographs, graphics, logos, and videos — is the exclusive property of BOA or its rights holders, and is protected under French and international intellectual property law (French Intellectual Property Code, Directive 2001/29/EC).

Any reproduction, representation, distribution, adaptation, or commercial use of any content, in whole or in part, without prior written consent from BOA is strictly prohibited and may give rise to civil and/or criminal proceedings.

Terms & Conditions

Payment

• Payment by bank transfer or PayPal only.
• 30% deposit required at the time of booking to confirm the reservation.
• Remaining balance (70%) payable no later than 45 days prior to arrival.
• Rates are subject to change without prior notice.

Security Deposit

A refundable security deposit of $1,000 is required, paid in cash on arrival, to cover any loss or damage of keys, contents, phone use, etc. The deposit is returned in full on departure, provided no damage or extra cost has occurred during the stay.

Occupancy

• Maximum occupancy: 4 persons (adults and/or children). This number may not be exceeded without prior written approval from the Owner.
• Subletting or transferring the rental to a third party is strictly prohibited.
• Domestic animals are welcome. An additional cleaning fee may apply.

Check-in & Check-out

• Check-in: from 3:00 PM (local time).
• Check-out: by 11:00 AM (local time).
• Early check-in or late check-out without prior written agreement from the Owner is strictly forbidden and may result in additional charges.

What's included

• Electricity, water, and WiFi.
• Private pool and tropical garden access.
• Bed linens and bath towels.
• Daily housekeeping service, except on Sundays and public holidays.
• 24/7 owner support.

Visitor Tax

A visitor tax applies in accordance with the regulations of the Collectivity of Saint-Barthélemy and is collected by the Owner on behalf of the Collectivity.

Cancellation Policy

A cancellation request or any changes to your reservation must be submitted in writing.

For low season:

• Cancellations received more than 60 days prior to arrival date, the deposit will be refunded less a 15% service fee ($150 minimum) assessed against the refund value.
• If cancellation is received 60 days prior to arrival date or less, 100% of the rental prices will be forfeited. When a reservation is canceled 90 days prior to arrival or less, refunds for properties will only be made if the property is rebooked for the period of the booking. If a portion of the rental time is rebooked, then a pro-rated refund will be made.

For high season:

• Cancellations received more than 90 days prior to arrival date, the deposit will be refunded less a 15% service fee ($150 minimum) assessed against the refund value.
• If cancellation is received 90 - 61 days prior to arrival date, 50% of the rental prices will be forfeited. When a reservation is canceled 90 days prior to arrival or less, refunds for properties will only be made if the property is rebooked for the period of the booking. If a portion of the rental time is rebooked, then a pro-rated refund will be made.
• If cancellation is received 60 days prior to arrival date or less, 100% of the rental prices will be forfeited. When a reservation is canceled 90 days prior to arrival or less, refunds for properties will only be made if the property is rebooked for the period of the booking. If a portion of the rental time is rebooked, then a pro-rated refund will be made.

Privacy Policy

In accordance with Regulation (EU) 2016/679 (GDPR) and French Law n°78-17 of 6 January 1978 (as amended), BOA, as data controller, informs you of the following:

Data collected

• Identity: first name, last name.
• Contact details: email address, phone number, postal address.
• Stay details: arrival/departure dates, number of guests.
• Technical data: IP address, browser type, and usage data collected via cookies for anonymous audience measurement.

Purpose of processing

• Managing rental reservations and booking inquiries.
• Fulfilling legal obligations (visitor tax, identity records).
• Improving the website through anonymous analytics.

Legal basis

Processing is based on the performance of a contract (rental agreement), compliance with legal obligations (visitor tax, Saint-Barthélemy regulations), and legitimate interest (website improvement and security).

Data retention

Personal data is retained for the duration of the contractual relationship and for a maximum of 5 years thereafter, in accordance with applicable French law. Accounting and tax records are kept for 10 years as required by law.

Data sharing

Your data is never sold or shared with third parties for commercial purposes. It may be disclosed to booking platforms (Airbnb, Booking.com, Marla Villas, SiBarth) in the context of a reservation made through those platforms, to service providers strictly necessary for the operation of the rental, and to public authorities when required by law.

Your rights

Under the GDPR, you have the right to access, rectify, erase, restrict, and port your personal data, as well as the right to object to its processing. You also have the right to lodge a complaint with the CNIL (Commission Nationale de l'Informatique et des Libertés) — www.cnil.fr.
